This website, mobile application or other digital or online application or service is operated by Reducetarian Foundation, Inc. (together with any affiliates, “Reducetarian Foundation, Inc.,” “we,” “us” or “our”). These Terms of Service apply solely to your access to, and use of, the movehumanityforward.com Web site operated by Reducetarian Foundation, Inc. and other Reducetarian Foundation, Inc. Web sites, mobile applications, or digital or online applications or services which link to these Terms of Service (collectively, the “Sites”).
We reserve the right to change or modify any of the terms and conditions contained in the Terms of Service or any policy or guideline of the Sites at any time and in our sole discretion. Any changes or modification to the terms and conditions will take effect immediately upon posting of the revisions on the Sites. You waive any right you may have to receive specific notice of such changes or modifications; your continued use of these Sites following the posting of changes or modifications will confirm your acceptance of such changes or modifications. 1. ELECTRONIC COMMUNICATIONS AND PRIVACY POLICY. You consent to our communicating with you about the Sites and Reducetarian Foundation, Inc. via email, text message, or other electronic means. Please refer to our Privacy Policy, available below (as such privacy policy may be updated from time to time in accordance with its terms, the “Privacy Policy”), for information on how we collect, use, and disclose information from our users. You agree that you will not provide any other person’s personal information to us unless you have the rights to do so under applicable law and have shared our Privacy Policy with the applicable person.
2. COPYRIGHT AND LIMITED LICENSE. Unless otherwise indicated on the Sites, the Sites and all content and other materials thereon, including, without limitation, Reducetarian Foundation, Inc.’s logo, and all designs, text, graphics, logos, icons, pictures, information, data, software, tools, widgets, sound files, other files and the selection and arrangement thereof (collectively, the “Site Materials”) are the proprietary property of Reducetarian Foundation, Inc. or its licensors or users and are protected by U.S. and international copyright laws. You agree not to change or delete any proprietary notices from materials printed or downloaded from the Sites. Unless explicitly stated herein, nothing in these Terms of Service shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise.
You are granted a limited, non-sublicensable, non-transferrable license to access and use the Sites and the Site Materials for your informational, non-commercial, and personal use only. Such license is subject to these Terms of Service and does not include: (a) any resale or commercial use of the Sites or the Site Materials therein; (b) the reproduction, distribution, public performance or public display of any Site Materials, except as expressly permitted on the Site; (c) modifying or otherwise making any derivative uses of the Sites and the Site Materials, or any portion thereof; (d) use of any data mining, robots or similar data gathering or extraction methods; (e) downloading (other than the page caching) of any portion of the Sites, the Site Materials or any information contained therein, except as expressly permitted on the Sites; or (f) any use of the Sites or the Site Materials other than for its intended purpose. Any and all licenses granted herein are revocable at any time.
Any use of the Sites or the Site Materials other than as specifically authorized herein without the prior written permission of Reducetarian Foundation, Inc. is strictly prohibited and will terminate the limited license granted herein. Such unauthorized use may also violate applicable laws, including, without limitation, copyright and trademark laws and applicable communications statutes and regulations.
3. REPEAT INFRINGER POLICY. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, Reducetarian Foundation, Inc. has adopted a policy of terminating subscribers or account holders who are deemed to be repeat infringers, in appropriate circumstances as determined by Reducetarian Foundation, Inc. in its sole discretion. Reducetarian Foundation, Inc. may also, at its sole discretion, limit access to the Sites and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4. TRADEMARKS. All logos and slogans contained in the Sites are trademarks of Reducetarian Foundation, Inc., its suppliers or licensors, or other third parties and may not be copied, imitated or used, in whole or in part, without the prior written permission of Reducetarian Foundation, Inc. or the applicable trademark holder. You may not use any metatags or any other “hidden text” utilizing “Reducetarian Foundation, Inc.” or any other name, trademark or product or service name of Reducetarian Foundation, Inc. without Reducetarian Foundation, Inc.’s prior written permission. In addition, the look and feel of the Site – including all page headers, custom graphics, button icons and scripts – is the service mark, trademark and/or trade dress of Reducetarian Foundation, Inc. and may not be copied, imitated or used, in whole or in part, without Reducetarian Foundation, Inc.’s prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned on the Sites are the property of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, and supplier or otherwise on the Sites does not constitute or imply endorsement, sponsorship, or recommendation thereof by Reducetarian Foundation, Inc..
5. HYPERLINKS. You may not use a Reducetarian Foundation, Inc. logo or other proprietary graphic of Reducetarian Foundation, Inc. to link to these Sites without the express written permission of Reducetarian Foundation, Inc.. Further, you may not use, frame or utilize framing techniques to enclose any Reducetarian Foundation, Inc. trademark, logo or other proprietary information, including the images found at the Sites, the content of any text or the layout/design of any page or form contained on a page on the Sites without Reducetarian Foundation, Inc.’s express written consent. Except as noted above, you are not conveyed any right or license by implication, estoppel or otherwise in or under any patent, trademark, copyright, or proprietary right of Reducetarian Foundation, Inc. or any third party.
Reducetarian Foundation, Inc. makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature, or reliability of third-party Web sites accessible by hyperlink from the Sites, or Web sites linking to the Sites. Such sites are not under the control of Reducetarian Foundation, Inc. and have separate applicable terms and policies, including privacy and data-gathering practices, and Reducetarian Foundation, Inc. is not responsible for the contents of any linked site or any link contained in a linked site, or any review, changes, or updates to such sites. Reducetarian Foundation, Inc. provides these links to you only as a convenience, and the inclusion of any link does not imply affiliation, endorsement, or adoption by Reducetarian Foundation, Inc. of any site or any information contained therein. When you leave the Sites, you should be aware that our terms and policies will no longer govern your activity. These Third Party Products and Services and Third Party Content are not under the control of Reducetarian Foundation, Inc. and have separate applicable terms and policies, including privacy and data-gathering practices, and Reducetarian Foundation, Inc. is not responsible for their content, quality, nature, reliability, privacy, data security or other practices or their handling of information you make available to them. Your business dealings with these third parties, and any terms, conditions, warranties, or representations associated therewith, are solely between you and such third parties. 7. PROHIBITED CONDUCT. You may not access or use, or attempt to access or use, the Sites to take any action that could harm us or any other person or entity, interfere with the operation of the Sites, or use the Sites in a manner that violates any laws. For example, and without limitation, you may not:

j. Engage in any other conduct that restricts or inhibits any person or entity from using or enjoying the Sites, or that, in our sole judgment, exposes us or any of our users, affiliates, or any other person or entity to any liability, damages, or detriment of any type; or
k. Otherwise use the Sites for any unlawful or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms of Service or any additional guidelines, policies or rules posted on the Site or otherwise provided to you.
Violations of system or network security may result in civil or criminal liability. We may investigate and work with law enforcement authorities to prosecute users who violate these Terms of Service. We may suspend or terminate your access to the Sites for any or no reason at any time without notice.
7. TRUTHFUL AND ACCURATE INFORMATION. When you complete forms online or otherwise provide us information in connection with the use of our Sites, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the Sites and pursue any appropriate legal remedies.
8. SUBMISSIONS. You acknowledge and agree that any feedback, questions, comments, suggestions, ideas, or other information or materials regarding the Sites or Reducetarian Foundation, Inc. that are provided by you in the form of email or other submissions to Reducetarian Foundation, Inc., or any such postings on the Sites, are non-confidential and shall become the sole property of Reducetarian Foundation, Inc.. Reducetarian Foundation, Inc. shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose without acknowledgment or compensation to you. To the extent you have any rights, title, or interest in any of the foregoing, you shall assign, and hereby assign, any and all such rights, title, and interest to Reducetarian Foundation, Inc..
9. USER CONTENT AND INTERACTIVE AREAS. The Sites may include interactive areas or services, such as forums, blogs, chat rooms or message boards, or other areas or services in which you or other users may create, post, share or store content, messages, materials, data, information, text, graphics, audio, video, or other items or materials on the Sites (“User Content”). You are solely responsible for your use of the Sites and use them at your own risk. You agree not to post, upload to, transmit, distribute, store, create, or otherwise publish through the Sites any User Content that would violate these Terms of Service, including, without limitation, any of the following:
a. User Content that is unlawful, libelous, defamatory, false, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, hateful, inflammatory, fraudulent, deceptive, or misleading;
b. User Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
c. User Content that may infringe, misappropriate, or otherwise violate any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party; or
d. Personal information or other private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers.
Reducetarian Foundation, Inc. takes no responsibility and assumes no liability for any User Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is Reducetarian Foundation, Inc. liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. Enforcement of the User Content or conduct rules set forth in these Terms of Service is at Reducetarian Foundation, Inc.’s sole discretion, and failure to enforce such rules in some instances does not constitute a waiver of our right to enforce such rules in other instances. In addition, these rules do not create any private right of action on the part of any third party or any reasonable expectation that the Sites will not contain any content that is prohibited by such rules.
As a provider of interactive services, Reducetarian Foundation, Inc. is not liable for any statements, representations, or User Content provided by its users in any public forum, blog, or other area of the Sites. Although Reducetarian Foundation, Inc. has no obligation to do so, it reserves the right, and has sole discretion, to remove, screen or edit any User Content posted or stored on the Sites at any time and for any or no reason without notice, and you are solely responsible for creating backup copies of and replacing any User Content you post or store on the Sites at your sole cost and expense. Any use of the Sites in violation of the foregoing violates these Terms of Service and may result in, among other things, termination, or suspension of your rights to use the Sites.
Except as otherwise provided, you retain ownership of all User Content you post on the Sites. However, if you post User Content to the Sites, unless we indicate otherwise, you grant Reducetarian Foundation, Inc. and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, assignable, transferable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content throughout the world in any manner or media now known or later developed, including without limitation in advertising, fundraising and other communications in support of Reducetarian Foundation, Inc. or the candidates, issues, organizations or causes supported by Reducetarian Foundation, Inc., without any right of compensation or attribution. You hereby waive any moral rights you may have in User Content. You grant Reducetarian Foundation, Inc. and its affiliates and sublicensees the royalty-free, perpetual, irrevocable, assignable, transferable, and worldwide right to use the name that you submit in connection with such content, if they choose. You represent and warrant that (a) you own and control all of the rights to the User Content that you post or you otherwise have the right to post such User Content to the Sites; (b) the User Content is accurate and not misleading; and (c) use and posting of the User Content you supply does not violate these Terms of Service and will not violate any other contract or legal obligation or violate any rights of or cause injury to any person or entity.
10. PRODUCT INFORMATION. All contribution amounts for products displayed on the Sites are quoted in United States Dollars and include all applicable sales and use taxes. You are solely responsible for complying with all applicable laws with respect to any access to the Site and ordering or use of such products outside of the United States.
All descriptions, images, references, features, content, specifications, products, and contribution amounts of products and services described or depicted on the Sites are subject to change at any time without notice. While Reducetarian Foundation, Inc. has tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate for the products you receive.
The products available on the Sites are for your personal use only. You may not sell or resell any products you purchase or otherwise receive from Reducetarian Foundation, Inc.. Promotions that offer a promotional code are for personal use only.
In the event that a product or service is mistakenly listed at an incorrect contribution amount or with incorrect specifications, Reducetarian Foundation, Inc. reserves the right to refuse or cancel any orders placed for the product or service listed incorrectly, whether or not the order has been confirmed and whether or not you have been charged for the contribution attributable to such product or service. If your credit card has already been charged for the contribution and your order is cancelled, Reducetarian Foundation, Inc. shall issue you a credit (to your credit card account or otherwise) in the amount of the incorrect amount.
11. ORDERS. If you wish to make a contribution in exchange for any product or service made available through the Sites (each such contribution, an “Order”), you may be asked to supply certain information relevant to your Order including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any Order. By submitting such information, you grant to Reducetarian Foundation, Inc. the right to provide such information to third parties for purposes of facilitating the completion of Orders initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Order.
As part of our Order processing procedures, we may screen all received Orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an Order due to suspected fraud or unauthorized or illegal activity. If we suspect fraud or unauthorized or illegal activity, we may reject your Order or our customer service department may call you at the phone number or email address you provided to confirm your Order. We also reserve the right to cancel any accounts or refuse to deliver to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our users as well as ourselves from fraud or other unauthorized or illegal activity.
You agree that by placing an Order on the Site, you are entering into a binding contract with Reducetarian Foundation, Inc. and you agree to pay all charges that may be incurred by you or on your behalf through the Sites, at the amount(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. We are not responsible for any fees or charges that your bank or credit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method including a mailed statement. Reducetarian Foundation, Inc. will use commercially reasonable efforts to complete delivery of all Orders in accordance with the shipping terms indicated at the time of your Order or any applicable shipping policies otherwise made available on the site, which are hereby incorporated into these Terms of Service. Risk of loss and title for items for which a Contribution is made by you pass to you upon Reducetarian Foundation, Inc.’s delivery of the items to the carrier.
Reducetarian Foundation, Inc. reserves the right to limit quantities of products made available through the Sites and to revise, suspend, or terminate an event or promotion at any time without notice (including after an Order has been submitted or acknowledged). We do not guarantee that all products described on the Sites will be available. Further, Reducetarian Foundation, Inc. reserves the right, with or without notice, to cancel or reduce the quantity of any Order to be filled or products to be provided to you that may result in a violation of these Terms of Service, as determined in our sole discretion.
12. COPYRIGHT COMPLAINTS. If you believe that anything on the Sites infringes upon any copyright which you own or control, please see 17 U.S.C. 512(c)(3) for the requirements of a proper notification. You should note that if you knowingly misrepresent in your notification that the material or activity is infringing, you will be liable for any damages, including costs and attorneys’ fees, incurred by us or the alleged infringer as the result of our relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing.
13. INDEMNIFICATION. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS Reducetarian Foundation, Inc., ITS INDEPENDENT CONTRACTORS, SERVICE PROVIDERS, LICENSORS, CONSULTANTS AND JOINT COMMITTEE MEMBERS, AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, ASSIGNS, AND AGENTS, FROM AND AGAINST ANY AND ALL LOSS, CLAIMS, ACTUAL OR THREATENED SUITS, DEMANDS, DAMAGES, FINES, PENALTIES, JUDGEMENTS, SETTLEMENTS, COSTS, LIABILITIES AND EXPENSES (INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEYS’ FEES) ARISING OUT OF, ASSOCIATED WITH, OR RELATED TO YOUR USE OF THE SITES OR ANY ALLEGED VIOLATION BY YOU OF THESE TERMS OF SERVICE OR THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, YOUR CONDUCT AND ANY USER CONTENT YOU POST, STORE OR OTHERWISE TRANSMIT ON OR THROUGH THE SITES, OR ANY ACT OR OMISSION RELATING TO THE SITES OR THE USER CONTENT.
14. DISCLAIMERS. YOUR USE OF THE SITES IS AT YOUR OWN RISK. EXCEPT AS EXPRESSLY PROVIDED TO THE CONTRARY IN WRITING BY Reducetarian Foundation, Inc., THE SITES, THE SITE MATERIALS CONTAINED THEREIN AND THE PRODUCTS AND SERVICES PROVIDED ON OR IN CONNECTION THEREWITH (COLLECTIVELY, THE “PRODUCTS AND SERVICES”) ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Reducetarian Foundation, Inc. DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SITES, THE SITE MATERIALS CONTAINED THEREIN AND THE PRODUCTS AND SERVICES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS AND AS TO ACCURACY OR RELIABILITY OF THE INFORMATION, CONTENT, FORMS OR OTHER SITE MATERIALS ACCESSED THROUGH THE SITE. DOES NOT REPRESENT OR WARRANT THAT THE SITES, THE SITE MATERIALS, ANY THIRD-PARTY SITES LINKED TO OR FROM THE SITES, OR THE PRODUCTS AND SERVICES ARE ADEQUATE, ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE, OR THAT THE FUNCTIONS PROVIDED WILL BE UNINTERRUPTED, VIRUS-FREE, OR ERROR-FREE.

15. LIMITATION OF LIABILITY. IN NO EVENT SHALL Reducetarian Foundation, Inc., ITS SUBSIDIARIES OR AFFILIATES, OR OUR OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, ASSIGNS, LICENSORS OR VOLUNTEERS BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE SITES, THE PRODUCTS AND SERVICES, THE CONTENT OR THE SITE MATERIALS CONTAINED IN OR ACCESSED THROUGH THE SITE, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM Reducetarian Foundation, Inc., OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, Reducetarian Foundation, Inc.’EVEN IF ONE OR MORE OF THEM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. WITHOUT LIMITATION OF THE FOREGOING, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF Reducetarian Foundation, Inc., WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITES OR THE SITE MATERIALS OR THESE TERMS OF SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO YOUR INTERNET SERVICE TO ACCESS THE SITES.

16. AGREEMENT TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS. Any claim, dispute or controversy of any kind, regardless of the type of claim or legal theory or remedy (“Claim”) by either you or Reducetarian Foundation, Inc. against the other arising from, relating to or in any way concerning the Terms of Service, Privacy Policy, or any goods you receive from us (or from any advertising for any such goods) must, at the demand of either party, be submitted to and determined by binding and confidential arbitration in Washington, D.C., before a single arbitrator. To the extent issues of state law are implicated, the laws of the State of New York shall apply. The arbitration will be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures in effect at the time of the arbitration and in accordance with the Expedited Procedures in those Rules. This agreement to arbitrate also includes: (i) Claims relating to the enforceability or interpretation of any of these arbitration provisions; (ii) Claims that relate directly to Reducetarian Foundation, Inc. and/or its affiliates, successors, assignees, employees, agents, or independent contractors; and (iv) Claims asserted as part of a class action, private attorney general or other representative action, it being expressly understood and agreed to by you and Reducetarian Foundation, Inc. that the arbitration of such claims must proceed on an individual (non-class and non-representative) basis and the arbitrator may award relief only on an individual (non-class and non-representative) basis. The parties shall maintain the confidential nature of the arbitration proceedings and award, including the hearing, except as may be necessary in connection with a court application for a preliminary remedy, a judicial challenge to an award or enforcement of the award, or unless otherwise required by law or judicial decision. Judgment upon the award rendered by an arbitrator hereunder may be entered in any court having jurisdiction.
YOU AND Reducetarian Foundation, Inc. HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT YOU HAVE TO A JURY TRIAL, OR AN APPEAL TO A STATE OR FEDERAL COURT OF APPEAL, WITH REGARD TO ANY DISPUTE ARISING UNDER, RELATING TO, OR IN CONNECTION WITH THE TERMS OF SERVICE, PRIVACY POLICY, OR ANY GOODS YOU RECEIVE FROM US (OR FROM ANY ADVERTISING FOR ANY SUCH GOODS). ALL SUCH DISPUTES SHALL BE RESOLVED THROUGH BINDING ARBITRATION AND NO CLASS ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL OR OTHER REPRESENTATIVE CLAIMS MAY BE PURSUED IN ARBITRATION. BY ACCEPTING THIS ARBITRATION AGREEMENT, YOU AGREE TO WAIVE THE RIGHT TO INITIATE OR PARTICIPATE IN A CLASS ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION OR CONSOLIDATED ARBITRATION IN ANY MATTER ENCOMPASSED BY THIS ARBITRATION PROVISION.
17. APPLICABLE LAW AND VENUE. These Terms of Service and your use of the Sites shall be governed by and construed in accordance with the laws of the State of New York applicable to agreements made and to be entirely performed within the State of New York, without resort to its conflict of law provisions. You agree that, subject in all cases to the mandatory arbitration provision set forth in Section 16 above, any action at law or in equity arising out of or relating to these Terms of Service shall be filed only in the state and federal courts located in the State of New York, and you hereby (a) irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms of Service, and (b) waive to the extent not prohibited by applicable law, and agree not to assert, by way of motion, as a defense or otherwise, in any such action, any claim that it is not subject personally to the jurisdiction of the above-named courts, that your property is exempt or immune from attachment or execution, that any such action brought in one of the above-named courts should be dismissed on grounds of forum non conveniens, should be transferred or removed to any court other than one of the above-named courts, or should be stayed by reason of the pendency of some other proceeding in any other court other than one of the above-named courts, or that these Terms of Service or the subject matter hereof may not be enforced in or by such court.
18. TERMINATION. Notwithstanding any of these Terms of Service, Reducetarian Foundation, Inc. reserves the right, without notice and in its sole discretion, to terminate your license to use the Sites, and to block or prevent your access to and use of the Sites.
19. MISCELLANEOUS. These Terms of Service and the Privacy Policy, which is hereby incorporated into and made a part of these Terms of Service, constitute the entire agreement between you and us, superseding any prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and us. If any provision of these Terms of Service shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions and will be replaced by an enforceable provision that comes closest to the intention underlying the unenforceable provision. You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms of Service or your access to and use of the Sites. Reducetarian Foundation, Inc. may assign these Terms of Service or its rights and duties under these Terms of Service to any party at any time without notice to you.
Our failure to enforce any provisions of these Terms of Service or respond to a violation by any party does not waive our right to subsequently enforce these Terms of Service or respond to any violations. Nothing contained in these Terms of Service is in derogation of our right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Sites or information provided to or gathered by us with respect to such use.
20. CONTRIBUTION POLICIES. All contributions to Reducetarian Foundation, Inc. through the Sites must be made from a contributor’s own funds, not funds provided to the contributor by another person, and using a personal credit card, not a corporate credit card. Contributions may not be made by any federal government contractor, foreign national lacking permanent-resident status in the United States, or using the general treasury funds of a corporation, labor organization or national bank.
21. CONTRIBUTION REFUND AND CANCELLATION POLICY. All contributions to Reducetarian Foundation, Inc. are final. Refunds and cancellations may be given at the sole discretion of Reducetarian Foundation, Inc.. If you believe that an error has been made in connection with your online contribution, contact us at info@reducetarian.org. We will endeavor to work with you to correct any such error.

Except as prohibited by the terms and conditions of any applicable Third Party Platform (e.g., Facebook, Twitter, etc.) and subject to the section entitled “OPTING OUT OF CERTAIN USES OF YOUR INFORMATION”, we may use information we collect for any of the following purposes:
Sending you Reducetarian Foundation, Inc. and affiliated committees’ marketing, promotional, e-mails, messages and other correspondence and notifications regarding the Services;

OPTING OUT OF CERTAIN USES OF YOUR INFORMATION.
User Account Privacy Settings. You may be able to adjust certain privacy, permission and User Account settings by responding to request alerts or notifications that may be presented to you on your Device prior to or following the collection of the relevant information or by navigating to the settings, account or privacy section (as the case may be) of your Device or the applicable Third Party Platform and limiting certain Service functionality (e.g., location services, etc.). Please be aware that if you limit the collection of certain information, you may not be able to use all of the features and functionality of the Services.
Marketing and Promotional Communications. At times, you may be presented with the option of whether to subscribe to receive or be automatically entered to receive, certain marketing and promotional communications, including by text message, from us that we think will be of interest to you. Recipients of such communications can unsubscribe by following the specific instructions included in such communications. Other privacy requests can be emailed to info@reducetarian.org. Please note that “opt-out” and “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process, and apply, during which time your information shall remain subject to the prior privacy settings.
Additionally, you should be aware that any information provided to third parties prior to your election to opt-out or unsubscribe cannot be retrieved or rescinded by us unless required by applicable law, and you cannot retroactively opt-out or unsubscribe with respect to such third parties.
Please note that in order to keep you informed about the operation of our Services and related services, notwithstanding any election to opt-out or unsubscribe from other communications, we may always send you emails and announcements that are needed for the proper functioning and administration of our Services. We may also have features that allow you to submit information, questions, or feedback to us. In those instances, we may retain your emails and other information you submit to us for our internal purposes, and to help us to serve you better.
Privacy Preferences. You may also change certain privacy preferences (e.g., choose to cease receiving certain communications or ask us not to share your personal information with a particular third party) by sending an email to us at info@reducetarian.org detailing your privacy request. If you ask Reducetarian Foundation, Inc. to stop using your personal information, we will honor that request, provided that we may retain a record of such information as necessary to comply with applicable law and we may continue to use your contact information to contact you about your Services-related transactions and to respond to your requests, as well as your IP address to determine the country in which you are accessing the Services. Other privacy preferences (e.g., deactivating your User Account, etc.) may be made by modifying your User Account settings on the Services, your Device and/or the applicable Third Party Platform. You always have the right to access, review and correct the personal information you have provided and generally, you may review, update or delete certain information collected by the Services at any time by accessing your User Account as described herein or by contacting us as described in the “CONTACT US” section below.
Opting Out of Use of Certain Information That May be Collected by Tracking Technologies.
Tracking Technologies: Most browsers are initially set to accept cookies (other than Flash cookies) and allow local storage, but you should be able to change your settings to notify you when a cookie is being set or updated, local storage is being used, and/or to block cookies and/or the use of local storage altogether. Please consult the “Help” section of your browser for more information. Please note that by blocking any or all cookies you may not have access to certain features, content, and/or other personalization available through the Services.
Flash Cookies: Users can manage the use of Flash technologies, with the Flash management tools available at Adobe’s website, see http://www.adobe.com/products/flashplayer/security/privacy_policy/faq.html.
Do-Not-Track Signals: Certain browsers transmit “do-not-track” signals to the websites with which such browsers communicate; however, this feature, and how it is used and activated, varies from browser to browser. Therefore, it is not clear whether the signals are intentionally transmitted by a user, or whether a user is even aware of this. Despite current efforts, there is still disagreement amongst leading Internet standards organizations, industry groups, technology companies and regulators, concerning what, if anything, websites should do when they receive such signals and no standard has been adopted to date. Reducetarian Foundation, Inc. takes privacy and security very seriously. With respect to “do not track signals,” we currently do not take action in response to these signals, but if a standard is established and accepted, we may reassess how to respond to these signals.
SHARING AND DISCLOSURE OF INFORMATION WE COLLECT.
Disclosure to Third Parties. We reserve the right to use, share, exchange and/or disclose to Reducetarian Foundation, Inc. affiliates, licensed chapters, related entities, and other third parties any of your information for any lawful purpose as described in the section entitled “HOW WE USE INFORMATION THAT WE COLLECT”. We may also disclose your personal information with your express consent. We may share aggregate, non-personally identifiable information about Site users with third parties.
Disclosure of Certain Information in User Submissions Intended to Be Disclosed. Certain information associated with a Submission may be intended for disclosure, such as your username. We will disclose any such information in connection with the display of, and other services relating to, such Submission, and by submitting a Submission on or in connection with the Services you affirmatively consent to the distribution of your information as described herein.
Service Providers, Owners, and Licensees. We may provide and disclose your information to affiliates, licensed chapters, related entities, operators, service providers, and other third parties for the purpose of providing, offering, supporting, administering and maintaining the Services or our and such parties’ activities, products and services, providing the full range of content, activities, services, features, and functions offered on or in connection therewith, or otherwise performing a business, professional or technical support function for us.
